Terms and Conditions

Please read all the terms and conditions before ordering your pet portrait. An order or commission means you have agreed to the terms and conditions set out below.

 

Payment

A 30% non-refundable deposit is required on ordering your pet portrait. Your portrait will not be booked into my schedule or begun until this payment has been received. Full payment is due when the portrait has been completed and approved. Once this final payment has been received, your portrait will be securely packaged and dispatched. (If paying by cheque time must be given for this to clear, usually 3-5 days). You will receive notification of when your portrait will be delivered on a one to one basis.

Payment of your deposit to secure your commission can be made via the BUY link on my Prices page; this allows you to select the size and number of subjects and media of choice. You can then choose to pay via Paypal, credit or debit card by following the instructions on screen. Alternatively you can pay by cheque or postal order, or gift voucher. If your delivery address is outside the UK and you order online you must pay by credit card or Paypal.
Online payments with Credit/Debit Cards or Paypal

To ensure that shopping online is secure, when paying by credit/debit card your details will be encrypted to minimize the possibility of someone being able to read them as they are sent over the Internet. Your credit card company may also carry out additional security checks to confirm it is you making the order. In the event your card is declined please contact your card issuer to authorise the transaction.

Cheque or Postal Order

If you reside in the UK, you may pay by cheque or Postal Order. Please make cheques payable to Kate Rosten and if you are unsure of the total please email me for an invoice. Please include a covering letter detailing your order, your contact details and delivery address.

Currency Exchange

Prices are quoted in UK pounds. Conversions of my prices to can be seen on my prices page. If you reside outside the UK your credit card company should exchange the amount charged to the currency of your country at the current rate. Please note that both charges and refunds are in UK pounds and I cannot be held responsible for any loss due to exchange rate fluctuation.

Gift Vouchers

Gift Vouchers cannot be exchanged for cash and are valid for one year from the date purchased. Vouchers will be dated, and the size, number of subjects and media will be booked. I reserve the right to view the voucher when the recipient orders their portrait. When redeeming, recipients who wish to add to their voucher will be purchasing on our current price list. Gift Vouchers are non-refundable.

Lead-Times

This varies at different times of the year and depends on the number and type of commissions I have booked in at the time. It usually is a matter of a few weeks at most. I will be able to advise you on when I might be able to do your commissioned pet portrait at the time of ordering.

Cancellation

If you cancel your portrait commission within 7 days of ordering and paying a deposit you will receive a full refund. If you wish to cancel your order after the 7 days, please notify me as soon as possible. At this time your 30% non-refundable deposit will be retained to cover administration, purchasing fees, materials, any time taken on your commission.

Rejection of Portrait after Completion

In the unlikely event you are not satisfied with the portrait and for some reason wish small alterations to be made, you must tell me within the 7 day approval period. If small changes need to be made, time must be allowed to make the alterations alongside other work and life commitments. You will receive an email with the photo of the changed piece of work for your approval. Once approved & payments made, I will send your portrait as outlined above.

Every effort is made to ensure your portrait is a good likeness to the photographs sent in an attempt to ensure clients are happy. If after changes you are still not satisfied with the portrait I will retain the 30% non-refundable deposit to cover administration, purchasing fees, materials and any time taken on your commission. The portrait will be retained to be sold at the full asking price established when the customer commissioned the portrait.

Rejection of Portrait Once Approved and shipped to customer? 

On receiving an approved portrait, you have a period of 7 days to contact me if you are not happy and require small alterations. The portrait must be packaged securely in its original packing, shipping costs returning the portrait to me and for the portrait to be shipped back to you must be paid by the customer. Time must be allowed to make the changes alongside other work and life commitments. I will email you photos of the artwork for your approval. If you approve the work and I have received the shipping costs to resend the portrait, it will be repackaged and dispatched for delivery as before and you will be notified of the new delivery date.

If after the changes have been made, the customer is still not happy and would like a refund, I will issue a refund for full cost of the commission minus the 30% non-refundable deposit which covers administration, purchasing fees, materials, any time taken on your commission. I will retain the portrait to be sold at the full asking price established when the customer commissioned the portrait & use the work as I see fit.

If a customer receives an approved portrait and wishes to have a refund but declines the opportunity for changes, a refund will only be made once the customer has returned the portrait to me in its original condition, in original packaging within 7 days. I will then complete the refund - there will be a cancellation fee of 30% of the total cost of the portrait. I cannot refund framing, prints or shipping costs.

Copyright

I retain copyright on all artwork I produce. Your portrait is for personal enjoyment only and cannot be copied or printed or used in any way for financial gain. By submitting an order form, either electronically or by post you are agreeing that I retain the full copyright and licensing rights to the artwork I produce from your photograph(s). If you would like to create prints or card etc. from the portrait, please contact me. I will be able to arrange this for you.

Once completed your portrait will be displayed on my website so people can view the quality of my work and could be used in promotional advertising.

Costumer emails and comments may be copied whole providing testimonials on my website or promotional material. If you prefer me not to use your comments this way please let me know at the time of ordering.

Photographs

Copyright of all photographs taken of your pet belong to the person who took the photograph. By sending me your photograph(s) electronically or by mail you granting me a license to use the images to create my own artwork or pet portraits and in advertising and promotional material for an indefinite period of time. It is the person who commissions and sends the photographs responsibility to gain full permission from the person who took the photograph that I may be able to use their photographs this way and cover any costs incurred against me by persons claiming to own copyright should they occur at any time.

Delivery

I can send portraits anywhere worldwide and provide a range of delivery services depending on the destination. Delivery costs can be found on my prices page. Delivery outside the EU may be subject to local import taxes, which are the customer’s responsibility.

Damage in Transit

I pack my portraits to a high standard, following official guidance of how art work should be packed and shipped. If in the unlikely event your portrait is damaged on delivery, photograph it, email me the photo and let me know what has happened. Then returned the portrait in its original packaging at your own cost and I will repaint or redraw the portrait for you free of charge. There will be a wait time on the replacement of artwork due to my booked client list.

Price changes

I reserve the right to change my pricing at any time. Orders made and agreed will always be honoured that the price when portrait was ordered and the 30% deposit was made. Gift vouchers will also be honoured at the price when the voucher was purchased. Gift Vouchers must be redeemed by the recipient within a year of purchase. All gift vouchers will be dated.
